Third-Party Data Services Agreement

NOTE: If you are an SVCE customer trying to share data with a third party, your use of this service is covered by the Account Holder Authorization and Agreement.

This Data Services Agreement (this "Agreement") is entered into by and between Silicon Valley Clean Energy ("SVCE") and the entity identified as the company seeking to obtain data services from SVCE ("Company"). This Agreement is effective as of the day you check a box indicating your agreement with the terms of this Agreement (the "Effective Date").

If you don't agree to this Agreement, do not use register or use this service.

SVCE uses the UtilityAPI, Inc. platform and services for third party functionality. When you register to use this Service, an account will be created on UtilityAPI's system that you will use to manage your settings and access Utility Data that Utility Account Holders have consented to share with you. By agreeing to this Agreement, you also agree to their UtilityAPI Data Services Agreement.

In addition to the UtilityAPI Usage Restrictions, you agree to the following additional usage restrictions.

Company will not:

  1. send or allow to be sent unsolicited marketing communications to, or otherwise make unsolicited contact with, Utility Account Holders. A marketing communication or contact shall be deemed unsolicited if the Utility Account Holder has requested has requested that the Company remove them from the Company’s contact list
  2. use the Silicon Valley Clean Energy name or logo in marketing communications or in any other way that would suggest endorsement by, or partnership or affiliation with, Silicon Valley Clean Energy.

In addition to the UtilityAPI Company Responsibilities, you agree to the following additional Company responsibilities.

Company will:

  1. use Authorization Data and Utility Data in accordance with the California Consumer Privacy Act,
  2. delete a Utility Account Holder's Authorization Data and Utility Data upon that Utility Account Holder's withdrawal of Consent.
